The EU AI Act is finally moving from discussion to reality, and for many CTOs, this marks the moment where what was once thought to be future regulations becomes a daily operational reality. Most people talking about the EU AI Act haven’t actually read it. Or they’ve skimmed a summary and decided it’s either a doom for innovation or a compliance checklist you can outsource. Neither is true, especially if you’re building high-risk AI. If you’re a CTO in Europe (or selling into Europe)the act is an engineering constraint, a product design requirement, and a risk management audit rolled into one. The good news is that most of what the law requires aligns with practices that mature engineering teams already try to follow. So here’s what you actually need, why it matters, and how to avoid waking up to a non-compliance notice.
What “high-risk” actually covers
High-risk systems are those that can impact safety, rights, or access to essential services. The EU says that if your AI shapes people’s access to critical services, evaluates or profiles humans, controls physical systems, handles identity, biometrics or classification or affects safety-critical industries, then you’re in the high-risk bucket. This includes medical diagnostics, credit scoring, recruitment tools, biometric identification, transportation controls, and other regulated products or services. The Act classifies systems by use and context, not just by the underlying model. If your system operates within a regulated workflow, assume it may be high-risk and document your reasoning.
Start with the documentation that the law expects
The Act requires technical documentation to be prepared before any high-risk system is placed on the market. It must explain what the model does, how it was trained, what data was used, how it was tested, and how it is monitored in production. That documentation must be kept up to date. Build this into your CI/CD so an auditor can pull a coherent artefact rather than hunting through emails.
Data lineage and bias checks
Regulators expect traceability for training data and a reasoned approach to bias mitigation. You must demonstrate the origin of the data, the processing method used, and explain why you believe it is suitable for its intended purpose. Bias testing cannot be an annual checkbox. Run bias and fairness probes pre-training, post-training and periodically in production. Log results and remediation steps.
What you can do is treat datasets like code. Version them. Run automated fairness tests in your pipeline. Keep a short, auditable note explaining any sampling or augmentation choices.
Build a live risk-management loop
A live risk-management loop is not just a requirement of the Act, but a proactive measure to keep your systems secure and compliant. By maintaining a documented risk register, monitoring systems for drift, and updating mitigations when new risks surface, you can stay ahead of potential issues and ensure your systems remain in compliance.
Human oversight that does actual work
You can’t just say “a human is in the loop” because the Act wants to define oversight roles, intervention procedures, override authority, as well as logs proving oversight. If a human can’t meaningfully intervene, the EU treats your system as autonomous, which triggers heavier obligations. What can be done here is to define a small set of authorised overseers. Create short runbooks that explain when and how to step in, and log every override as part of the audit trail.
Robustness, adversarial tests and security
You must show the system behaves acceptably under realistic stress. Test for noisy inputs, shifted distributions, and common adversarial attacks. Protect model weights, training data, and inference APIs with standard security controls. If your model can be trivially fooled, your mitigation story is weak.
Transparency for users
End users need clear, practical explanations. Inform them that the system is AI-driven, explain its functionality, and outline how they can challenge decisions. You do not need to publish internal model secrets; you must provide meaningful, actionable explanations and an appeals route. This forces UX, engineering and legal to meet in one room for once.
Logs, versioning and audit readiness
The Act expects traceable artefacts. Keep logs of training runs, data versions, model versions, inference requests (including sampled requests), human overrides, and monitoring alerts. Make logs queryable for audits. A messy filesystem with scattered reports is the single fastest path to a bad audit outcome. You can start by centralising logs in a searchable store and tagging them with release IDs. Automatically export a compliance package upon release.
Third-party models and provider responsibility
You should require vendors to provide artefacts and provenance statements. If they can’t, treat the model as “untrusted” and apply stronger monitoring. Using a third-party model does not transfer compliance. If you deploy or fine-tune an externally sourced model in a high-risk use, you are responsible for demonstrating compliance. That includes provenance of training data, robustness testing and transparency. Don’t assume a vendor-provided shim is enough.
Recent guidance and the political context
The Commission and its officials have framed the Act as enabling trustworthy AI while protecting rights. Commissioner Thierry Breton said the law aims to let “European citizens and businesses use AI ‘made in Europe’ safely and confidently.” The Commission has also released FAQs and a voluntary Code of Practice to help businesses prepare for the changes. You can expect guidance updates and sectoral clarifications as enforcement dates approach.
A short roadmap for the next 90 days

- Automate dataset versioning and basic bias checks.
- Create a living technical documentation template and start filling it now.
- Instrument production with drift detection and a simple oversight dashboard.
- Package an audit bundle (including documents, logs, and tests) and store it with each release.

Teams that embed documentation, testing and transparency into everyday workflows will build systems that customers can trust and regulators can verify. This work also reduces operational surprises and litigation risk. If you make compliance a set of engineering routines, not a paperwork project, your product becomes stronger.
